Description

Registry office or licensed venue, such as a hotel, if you’re having a non-religious (civil) ceremony You might not have been able to get the consent of your parents, perhaps because you don't know where they are. Or your parents might have refused to give their consent for you to get married. If this was the case, you would have needed permission from a court to get married. The Mental Capacity Act Code of Practice goes into this much more fully. It sets out five basic principles an attorney has to follow when working out whether and how to act on your behalf:

Make sure the instructions you leave are easy to understand and follow, as you won't be around to explain your reasoning. Are you happy for your attorneys to choose whether they make decisions together or individually? Choose ‘jointly and severally’, which is the most straightforward option. This might be what you want – however, a lot of people prefer their attorneys to act ‘jointly and severally’, giving them more freedom and flexibility. For example, if you can’t leave the house or it’s hard to talk to your electricity supplier, you might ask your attorneys to deal with the bank or pay bills. You could ask your attorneys to act for you if you are away – for example, on holiday. If your witness intentionally refuses to give the evidence they were called to give, which includes deliberately giving contrary evidence, then you should carefully consider making an application to the judge to treat them as a hostile witness. Advocates use examination in chief to question their witnesses after they have been sworn into court and before they are cross examined by the other side.

Certain marriages are treated as if they never took place. These are called void marriages. They are marriages which do not meet the requirements of United Kingdom law. An example of a void marriage is one where the partners may not marry because they are related. Yes as long as the person is over the age of 18 and able to understand the responsibility of becoming an attorney. You and your partner will be asked for certain information when giving notice of your intention to marry. If you or your partner are not citizens of a European Economic Area country, you'll also have to submit evidence of your immigration status when you give notice to marry. If the judge grants your application you will be allowed to cross examine your own witness when they give their evidence. In criminal proceedings their original statement can also then become evidence of any admissible fact stated in it. For a health and welfare LPA, your attorney can only act for you once you’ve lost the ability to make your own decisions.

Resources and tools

What might stop your attorneys working together? Do they get on? What could happen if they were to fall out? show you around the court so you know what to expect on the day (sometimes called a pre-trial visit) You don’t have to have complex health or care problems to make an LPA. It’s a way of planning for your care in case you can’t make decisions for yourself in future. People involved in your LPA If you choose this option, you must not say anywhere else in the LPA that certain decisions must be made by:

Os ydych chi’n rhoddwr, neu’n unigolyn y mae’r atwrneiaeth arhosol ar ei gyfer, rhaid i’ch tyst fod dros 18 oes, ac ni all fod yn atwrnai wedi’i enwi nac yn atwrnai newydd. If your original attorneys have to make all or some decisions jointly and one can no longer act, your replacement attorneys will make those joint decisions instead. Both your remaining original attorneys and your replacements can make any decisions that don’t have to be made jointly. If you’re a defence witness, ask the defence lawyer if you can get a translator. Help preparing to give evidence Witnesses who can't remember their evidence are sometimes referred to as unfavourable or unhelpful witnesses. Before writing your will, it's worth identifying all the assets you own, as well as any sentimental items you'd like to leave to loved ones. You should also work out arrangements for your children's care, and consider whether you'd like to leave specific instructions for your funeral.
